Republican senators Hatch and Kyl, longtime gambling opponents, are urging Attorney General Eric Holder to review the legal validity of Delaware's legalized sports betting program.

The Senators pose that Delaware does not have the authority to offer sports gambling in the manner that they have proposed, because their exemption from the federal sports gambling ban can only go as far as the betting program that was in force in the state when Delaware was exempted from the federal law.

Delaware's previous sports lottery did not allow punters to bet on individual games, whereas the current proposal does allow such.

This, the Senators say, is illegal.

It remains to be seen whether Delaware will be able to get its sports betting program in place by 2009 NFL Football season, as it had proposed to do.
